You may have read this already (from Feb), explaining the distinction between the two answers to the complaint. I can upload the answers if you want to see them.
 http://1.usa.gov/AsKkKG

Here's the order granting Hawaii Family Forum's motion to intervene.
 http://www.scribd.com/doc/93829405/43

I've only skimmed the order, but from what I read, it grants intervention as a right, saying HFF meets all four criteria. The opposing position of the two state defendants does factor into the judge's analysis of one of the criteria - that of whether HFF's interests will be adequately represented.

If there are any other documents from the case you want to read, let me know and I'll get them.

It is bizarre. The governor said he would not defend it but that notwithstanding the AG has TWO separate teams of lawyers on the case - one in favor of having the referendum declared unconstitutional and the other team defending it on behalf of the Dept of Health clerk who is in charge of marriage licenses.

Kathleen do you know about the Federal district court allowing the Hawaii Family Forum to intervene to defend the Hawaii same sex marriage case? THe position of the Governor and AG in this case is very confusing and may have led to this.

Nothing new on decision re: en banc in Perry or Golinski. As to 2nd Circuit, do you mean 1st Circuit (Mass DOMA cases)? If so, there has been no decision on those either. Typically, if there is such a thing as typical, figure about 3 months from oral arguments to decision. Oral argument in those cases was early April.
