I've only skimmed the order, but from what I read, it grants intervention as a right, saying HFF meets all four criteria. The opposing position of the two state defendants does factor into the judge's analysis of one of the criteria – that of whether HFF's interests will be adequately represented.

The governor said he would not defend it but that notwithstanding the AG has TWO separate teams of lawyers on the case – one in favor of having the referendum declared unconstitutional and the other team defending it on behalf of the Dept of Health clerk who is in charge of marriage licenses.

As to 2nd Circuit, do you mean 1st Circuit (Mass DOMA cases)? If so, there has been no decision on those either. Typically, if there is such a thing as typical, figure about 3 months from oral arguments to decision. Oral argument in those cases was early April.
