    Looking at the WSJ article and setting aside the "SCOTUS takes neither Prop 8 nor DOMA" scenario and assuming we all want DOMA taken up, I wonder: if you could make the call for the Court, would you have them deny cert or grant cert for the Prop 8 case? The narrowness of the ruling makes me lean to deny, and just give CA equality ASAP….

    Also in news, Mexican Supreme Court just struck down marriage ban in Oaxaca, the court there cannot just en mass strike down all state laws but this ruling means if challenged the rest of the laws will fall, this is in essence a ruling for same sex marriage nationwide in Mexico!

    Not sure if you're asking Scottie or the general readership. If you're asking whoever might be reading this post, then I agree with you that SCOTUS should not grant cert on the Prop 8 case and let it stand as currently decided. While I would not automatically assume that granting cert on this case would automatically be a bad sign (and there are issues involved in the particular case apart from the obvious question of marriage equality), it seems unlikely that even a favorable Supreme Court decision on the Prop 8 case would, as some hope, overturn all state laws that ban same-sex marriage. This particular Supreme Court simply isn't going to go that far in our direction.

    I agree with sfbob's thoughts, but I'd add "at this time" to his comment regarding this particular court overturning all state marriage bans. I can see this same lineup of justices voting for marriage equality in the future once more states have gone that way, but it is very unlikely that they will go there yet.

    I'm losing track of countries that are poised to get to the equality finish line ahead of us….Mexico, France, Colombia, Uruguay….

    Yes, definitely putting it out for anyone's thoughts. I also don't think our side has much to gain…at this time…by SCOTUS taking up the Prop 8 case.

    I also found it interesting that the WSJ neglected to mention the District court ruling when discussing the Prop H8 case. What does the WSJ think will happen if SCOTUS likes the decision of the Ninth Circuit, but finds that at least one party doesn't have standing? Does that mean the District Court ruling stands, even if SCOTUS doesn't believe it's the correct ruling? Accept cert, then send the case back to the 9th with instructions to hear it with all parties having standing? Accept cert and rule, with or without acknowledging one or more parties don't have standing? Deny cert in total (thus implicitly stating that all parties have standing?)

    Remember, the WSJ is no longer (if it ever was) a 'disinterested' newspaper, not since it was purchased by Rupert Murdoch's NewsCorpse.

    Waiting for the Supreme Court of the United States to issue a decision on California's Proposition 8 can feel like waiting for your alcoholic ex-girlfriend, who also happens to be a pathological liar, to pay back the money she borrowed from you so that she could rent a truck to move her crap out of your basement. She can say she's going to pay you back, but you've heard it all before.
