For one thing, he's kinda tied up challenging the healthcare law for three days in front of the Supreme Court next week.

But more important, the military challenge to DOMA is kryptonite. Denying family benefits to LGBT servicemembers will elicit sympathy that the other DOMA challenges can't. BLAG won't unleash that particular media frenzy until they have to.
